RØUT — Ghost Racing & AI Coaching for Runners

1. Acceptance of Terms
By downloading, installing, or using RØUT (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you (“User,” “you”) and David Capp (“Developer,” “we,” “us,” “our”), a sole trader based in the United Kingdom and the independent developer of RØUT. Our contact email is inforoutrun@gmail.com.
2. Description of Service
RØUT is an iPhone and Apple Watch application for recreational runners. The App provides:
- Run recording on Apple Watch using GPS and heart-rate sensors
- Ghost racing that pits you against your personal best over the same distance
- Post-run audio debriefs generated by the RØUT Coach Engine, which analyses your pacing, splits, heart-rate zones, and ghost-race result
- Apple Health integration to read existing workouts and save new ones
- Optional Strava upload if you connect your Strava account
The App is designed as a training companion for recreational runners. It is not a medical device, a clinical fitness assessment tool, or a safety application.
3. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.
4. Subscriptions and Payments
4.1 Free and Premium Tiers
RØUT offers both free and premium (RØUT Premium) functionality. Certain features require an active RØUT Premium subscription.
4.2 Subscription Terms
- Subscriptions are available on a monthly or yearly basis
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
- You can manage and cancel subscriptions in your Apple ID Account Settings after purchase
4.3 Free Trials
- If offered, free trial periods automatically convert to a paid subscription at the end of the trial
- Any unused portion of a free trial is forfeited when you purchase a subscription
- Cancellation during the free trial period will not result in a charge
4.4 Price Changes
We may revise subscription pricing at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use after a price change constitutes acceptance of the new price.
4.5 Refunds
All purchases are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policy. We do not process refunds directly.
4.6 Right to Cancel (UK Consumers)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK consumers ordinarily have a 14-day right to cancel a purchase of digital content. By subscribing to RØUT Premium and beginning to use premium features immediately, you expressly consent to the supply of digital content before the end of the 14-day cancellation period and acknowledge that you thereby lose your right to cancel under those Regulations. This does not affect your statutory rights under the Consumer Rights Act 2015 (see Section 9).
5. User Conduct
When using the App, you agree to:
- Use the App only for its intended purpose of recording your runs and receiving coaching feedback
- Comply with all applicable local, national, and international laws while running with the App
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not interfere with or disrupt the App's servers or infrastructure
- Not attempt to bypass any subscription or access restrictions
- Not misuse the Strava integration to upload activities that violate Strava's own Terms of Service
6. Safety and Assumption of Risk
6.1 Running Safety
IMPORTANT: Running is a physical activity that carries inherent risk. You assume all risk when running, including while using the App.
- Always assess your surroundings before and during any run
- Do not look at your iPhone or Apple Watch display while running in traffic or near hazards
- The RØUT audio debrief is delivered after your run, not during — do not interact with the App while running in a way that compromises your awareness
- You are solely responsible for choosing a route, distance, and pace appropriate to your environment and fitness level
6.2 GPS and Sensor Accuracy
- GPS accuracy varies by environment; signals may be unreliable in tunnels, dense urban areas, forests, or near tall buildings
- Heart-rate readings from Apple Watch are provided by Apple and may not be precise, especially under rapid movement or cold weather
- The App's distance, pace, and heart-rate data should be treated as approximate and is not suitable for clinical use
6.3 Physical Activity and Health
- RØUT is not a medical application and does not provide health, medical, or fitness advice.
- Consult a medical professional before beginning any new exercise routine, particularly if you have a history of cardiovascular, musculoskeletal, or other health conditions
- Although the App reads heart-rate and workout data from Apple HealthKit to power features such as ghost racing and coaching analysis, it does not monitor your health in real time and is not a substitute for medical monitoring
- If you experience dizziness, chest pain, shortness of breath, or any other warning sign during a run, stop immediately and seek medical attention
6.4 AI Coaching Output
- Coaching debriefs are generated by automated analysis and artificial intelligence
- Coaching output may be inaccurate, incomplete, or unsuitable for your particular circumstances, and should be treated as general commentary on your run rather than personalised training advice
- Do not rely on RØUT Coach Engine output as a substitute for coaching from a qualified human trainer
6.5 Weather Information
- Weather data is provided via Apple WeatherKit for informational purposes only
- Conditions may change rapidly and without warning
- Do not rely solely on the App's weather information for safety decisions
7. Intellectual Property
7.1 App Ownership
The App, including its design, code, AI systems, the RØUT brand and mark, and all associated intellectual property, is owned by David Capp. These Terms do not grant you any ownership rights in the App.
7.2 Your Content
- Runs you record, ghost-race data, and locally cached coaching debriefs are your content and are stored on your device and in your Apple Health library
- You retain ownership of any workout files (GPX) you export or upload
- By using the RØUT Coach Engine, you grant us a non-exclusive, limited licence to process your run summary (distance, duration, splits, heart-rate summary, ghost-race result, and weather) solely for the purpose of generating your coaching debrief
7.3 Data Attribution
- Map data, where displayed in the App, is provided by Apple MapKit
- Workout, heart-rate, distance, and route data are managed by Apple HealthKit
- Weather data is provided by Apple WeatherKit
- If you connect your Strava account, activity uploads are subject to Strava's Terms of Service and API Agreement
8. Disclaimers
8.1 “As Is” Provision
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 No Guarantees
We do not guarantee that:
- The App will be available at all times or without interruption
- Workout recording, ghost-race comparisons, or coaching debriefs will be accurate, error-free, or suitable for any particular purpose
- Data synced to Apple Health or Strava will be free from errors or delays
- Weather data will be precise
- The App will be compatible with all devices or operating system versions
- Third-party services (Apple Health, Apple WeatherKit, Strava, analytics providers) will be available, accurate, or performant
8.3 Third-Party Services
The App relies on third-party services, including Apple WeatherKit, Apple HealthKit, Apple App Store / StoreKit, PostHog (analytics), Railway (our coaching backend host), and — if you connect your Strava account — Strava Inc. These services are outside our control. We are not responsible for their availability, accuracy, or performance. Your use of each third-party service is also subject to that service's own terms.
9. Limitation of Liability
9.1 Statutory rights that are NOT excluded
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under English law, including your rights as a consumer under the Consumer Rights Act 2015 (for example, that digital content supplied to you is of satisfactory quality, fit for purpose, and as described)
- Any other liability that cannot lawfully be excluded
If any provision of this Section 9 is held to be unenforceable against you as a consumer, that provision shall be severed and the remainder of these Terms shall continue in force.
9.2 Excluded damages
Subject to Section 9.1, and to the maximum extent permitted by applicable law, in no event shall David Capp be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Property damage arising from your use of the App
- Loss of data, including run history, ghost-race records, or coaching debriefs
- Interruption of service or inability to access the App
- Errors or inaccuracies in workout recording, coaching analysis, weather data, or data synced to Apple Health or Strava
- Any actions taken based on information provided by the App
9.3 Liability cap
Subject to Section 9.1, our total aggregate liability to you for any claim arising from or related to the App shall not exceed the greater of (a) the total amount you paid for the App in the twelve (12) months preceding the claim, or (b) £100.
10. Indemnification
You agree to indemnify and hold harmless David Capp from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any applicable laws while using the App
- Your violation of Strava's Terms of Service while using the RØUT–Strava integration
- Any injury to yourself or others while running with the App
11. Apple HealthKit Terms
RØUT integrates with Apple HealthKit to read existing workout and heart-rate data (to power ghost racing and coaching) and to save completed runs (as HKWorkout, HKWorkoutRoute, heart rate, distance, active energy, and advanced running metrics).
In accordance with Apple's requirements for HealthKit apps, we commit that:
- We will not use HealthKit data for advertising or similar services
- We will not disclose HealthKit data to any third party without your express authorisation, and never for the purpose of advertising, data brokerage, or data mining
- We will not sell HealthKit data to any third party
- HealthKit data is processed on your device and stored in Apple Health under Apple's security model; we do not transmit HealthKit data to our servers
You may grant or revoke HealthKit permissions at any time under Settings → Privacy & Security → Health → RØUT Run. Revoking permissions may disable core features of the App, including ghost racing and the Coach Engine.
12. Strava Integration (Optional)
If you choose to connect your Strava account to RØUT, the following additional terms apply:
- Connecting Strava is entirely optional. The App's core features work without a Strava connection.
- You authorise RØUT to upload the runs you record in the App to your Strava account, using the
activity:writescope (andactivity:readsolely to detect duplicate uploads). - Strava access tokens are stored only on your device in the iOS Keychain. RØUT does not hold your Strava credentials on any server.
- You can disconnect at any time in RØUT Settings, which revokes RØUT's access on Strava's side and deletes all stored Strava tokens from your device.
- Your use of Strava through RØUT is also governed by Strava's Terms of Service and Strava API Agreement. You are responsible for your own compliance with Strava's terms.
- RØUT is not affiliated with, endorsed by, or sponsored by Strava Inc. Strava may modify, suspend, or revoke API access at any time, and RØUT cannot guarantee continued availability of the Strava integration.
- RØUT is not responsible for Strava's availability, data accuracy, or any loss of data resulting from your use of Strava.
13. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.
14. Termination
14.1 By You
You may stop using the App at any time by deleting it from your device. To stop subscription billing, cancel your subscription through your Apple ID Account Settings before the next renewal date.
14.2 By Us
We reserve the right to suspend or terminate access to the App if you violate these Terms, misuse the RØUT–Strava integration in a way that breaches Strava's terms, or engage in fraudulent billing activity. In the event of termination, provisions regarding disclaimers, limitation of liability, indemnification, intellectual property, and HealthKit obligations shall survive.
15. Modifications to the App
We reserve the right to modify, update, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any feature (including the Strava integration or the Coach Engine backend).
16. Changes to These Terms
We may update these Terms from time to time. When we make changes:
- The “Last Updated” date at the top of this page will be revised
- Material changes will be communicated via App Store update notes
- Your continued use of the App after changes constitutes acceptance of the revised Terms
We encourage you to review these Terms periodically.
17. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in Scotland or Northern Ireland, you retain the right to bring proceedings in the courts of the part of the United Kingdom in which you are resident, and the mandatory consumer-protection laws of your jurisdiction will continue to apply to you.
18. Apple-Specific Terms
These Terms are between you and David Capp, not with Apple Inc. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce these Terms against you.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and David Capp regarding the use of the App and supersede all prior agreements or understandings.
